These Terms of Service (“Terms”) govern your use of goldmobilenumber.com (the “Site”) and any enquiry, offer, number search, or purchase of a mobile telephone number offered through the Site (each a “Number”).

By using the Site, submitting an enquiry, making an offer, requesting a number search, or completing a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or buy a Number.

We operate as a private seller of distinctive mobile numbers offered as personal property. Displayed prices are illustrative unless we confirm a price in writing or you complete checkout for a listed Number.

1. What we sell

Numbers are offered as a private collection item: a transfer of personal property (the right to use that mobile number) subject to the rules, identity checks, and porting processes of whichever network or provider you choose.

We do not sell a mobile plan, SIM card, handset, or ongoing service. Any prepaid or postpaid plan, credit, or network fees with your chosen provider are separate and your responsibility.

Listing a Number on the Site does not reserve it. Availability is confirmed when we accept your purchase in writing or when Stripe payment for that Number clears, whichever we state at the time.

2. Enquiries, offers, and number searches

Enquiries and offers are invitations to discuss. They are not binding on either party until we confirm acceptance in writing (including by email).

“Request a number” and similar searches are best-effort only. We may search wholesale or other available inventory. We have no obligation to find a match, reserve a Number, hold inventory, or reply within a set time.

Wholesale stock (including inventory from third-party carriers or number suppliers) can change or disappear without notice. A search result is not a guarantee that a Number remains available to buy or transfer.

3. Purchase and payment

Online checkout (where offered) is processed by Stripe. Card details are handled by Stripe; we do not store full card numbers on our systems.

Until payment clears or we accept terms in writing, no Number is reserved for you.

After payment, we will confirm next steps for transfer or porting in writing. Timing depends on you, your provider, and third parties we do not control.

4. As-is sale; no warranties

Numbers are sold as is and as available. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, non-infringement, uninterrupted use, or that a Number will work for voice, SMS, messaging apps, or any other service on any network.

Without limiting the above, we make no promise that:

any carrier or provider will accept, activate, or port the Number;
identity, KYC, or other checks will succeed;
transfer or porting will complete within any timeframe, or at all;
the Number will remain assigned to you after transfer if a provider later reclaims, suspend, or cancel it under their rules;
“gold,” prestige, pattern, or resale value will meet any expectation;
wholesale or listed inventory will still be available when you are ready to buy.

You are responsible for checking with your intended provider, before paying where possible, that the Number can be ported or activated on the service you want.

5. Refunds

Except where we agree otherwise in writing, sales are final once Stripe payment clears or we confirm acceptance in writing.

Refunds, if any, are at our sole discretion (for example if we cannot complete a transfer for reasons within our control and we choose to cancel the sale). Provider refusal, KYC failure, delays, or your change of mind do not automatically entitle you to a refund.

6. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost business, loss of goodwill, or cost of substitute numbers or services, arising out of or related to the Site, a Number, an enquiry, a search, or a purchase, whether based in contract, tort (including negligence), strict liability, or otherwise, even if we were advised of the possibility.

To the fullest extent permitted by applicable law, our total liability for any claim relating to a particular Number or transaction is limited to the fees you actually paid us for that Number (or, if you paid us nothing for that Number, one hundred Australian dollars (AUD $100)).

We are not responsible for acts or omissions of carriers, providers, Stripe, hosting providers, Cloudflare, wholesale suppliers, brokers, or other third parties; for regulatory or industry changes; or for your use of a Number after transfer.

7. Your responsibilities and indemnity

After transfer, you are solely responsible for how the Number is used, including compliance with law and provider rules. You must not use a Number for spam, fraud, harassment, or any unlawful purpose.

You agree to indemnify and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your misuse of a Number, your breach of these Terms, or your dealings with any provider after transfer.

8. Site use

You may use the Site for lawful enquiries and purchases only. You must not scrape, overload, or interfere with the Site, or submit false contact details.

Content on the Site (design, text, logos, and arrangement) is protected. You may not copy it for commercial use without our written permission, except as needed to use the Site as a customer.

9. Privacy

Personal information is handled as described in our Privacy Policy.

10. Changes

We may update these Terms by posting a revised version on the Site. The “Last updated” date will change. Continued use after posting means you accept the revised Terms for future use of the Site and new transactions. Existing confirmed sales remain subject to the Terms in force when we accepted that sale, unless we agree otherwise in writing.

12. General

These Terms are the entire agreement between you and us regarding the Site and Numbers, and supersede prior discussions on the same subject, except for a written confirmation we send for a specific sale.

If a provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.

These Terms are governed by the laws of the seller’s jurisdiction, without regard to conflict-of-law rules that would require another forum. Courts in that jurisdiction may hear disputes, without limiting any right we have to seek relief elsewhere.
